ARTICLE 1 - GENERAL PROVISIONS

  1. The user navigating in this area accesses www.perbellini.com, accessible through the url: www.perbellini.com (henceforth called "PASTICCERIA PERBELLINI"). Browsing and transmitting a purchase order on the site implies acceptance of the Conditions and Data Protection Policies adopted by the site itself indicated therein.
  2. These General Conditions of Sale apply to the sale of products with exclusive reference to purchases made on the site in accordance with the provisions of Part III, Title III, Chapter I, Consumer Code (Legislative Decree no. 206/05 as amended by Legislative Decree no. 21/14 and Legislative Decree 70/03) by PASTICCERIA PERBELLINI ERNESTO S.R.L., registered office in Via Vittorio Veneto, 45 - 37051 Bovolone (VR) - P.IVA and C.F. 00110970233.
  3. You are required, before accessing the products provided by the site, to read these Terms and Conditions of Sale, which are generally and unequivocally understood to be accepted at the time of purchase.
  4. Such purchases are reserved for end-consumer Customers (i.e., an individual who purchases the goods for purposes not related to his or her professional activity), thus excluding entities such as traders, wholesalers, retailers, professionals, etc. who intend to resell the relevant products to third parties.
  5. You are encouraged to download and print a copy of the purchase form and these Terms and Conditions, the terms of which are detailed of the following chapters.

ARTICLE 2 - OBJECT

  1. The present General Conditions of Sale regulate the offer, the forwarding and the acceptance of purchase orders of products on PASTICCERIA PERBELLINI and do not regulate, instead, the supply of services or the sale of products by subjects different from the seller that are present on the same site through links, banners or other hypertextual links.
  2. Before placing orders and purchasing products and services from different parties, we suggest checking their terms and conditions.

ARTICLE 3 - CONCLUSION OF THE CONTRACT

  1. To conclude the purchase contract, you will need to fill out the form electronically and submit it following the relevant instructions.
  2. It contains a reference to the General Terms and Conditions of Sale, images of each product and its price, the means of payment that can be used, the mode of delivery of the purchased products and the related shipping and delivery costs, a reference to the conditions for exercising the right of withdrawal; how and when to return the purchased products.
  3. Before concluding the contract, you will be asked to confirm that you have read the General Terms and Conditions of Sale including the Right of Withdrawal and Personal Data Processing Notice.
  4. The contract is concluded when the seller receives the form completed by the user, after checking that the data contained therein are correct.
  5. The user will be obligated to pay the price from the moment the online order submission process is completed. This will be done by clicking on the "COMPLETE ORDER" button at the end of the wizard.
  6. When the contract is concluded, the seller takes over the order for fulfillment.

ARTICLE 4 - REGISTERED USERS

  1. In completing the registration procedures, you agree to follow the directions on the site and to provide your personal information correctly and truthfully.
  2. Once the registration is done, the user will receive a confirmation email in the email provided by him/her. The confirmation must be communicated within a maximum of 2 days. After this period, failing confirmation, he will be released from any commitment to the user.
  3. The confirmation will exonerate in every case PASTICCERIA PERBELLINI from every responsibility about the data furnished by the user. L' user is obliged to inform PASTICCERIA PERBELLINI timely of any variation of own data in every time communicated.
  4. If then the user communicates not exact or incomplete data or also in the case in which there is dispute from the interested subjects about the effected payments, PASTICCERIA PERBELLINI will have the faculty not to activate or rather to suspend the service until the relative lacks are remedied.
  5. On the occasion of the first request for activation of a profile by the user, PASTICCERIA PERBELLINI will attribute to the same user name and a password. The latter acknowledges that these identifiers constitute the validation system of the user's accesses to the Services and the only system suitable to identify the user that the acts performed by means of such access will be attributed to him and will have binding effectiveness towards him.
  6. The user agrees to maintain the secrecy of his or her access data and to guard it with due care and diligence and not to transfer it even temporarily to third parties.

ARTICLE 5 - PRODUCT AVAILABILITY

  1. Product availability refers to actual availability at the time the user places the order. However, this availability should be considered purely indicative because, as a result of the simultaneous presence on the site of several users, products may be sold to other customers before the confirmation of the order.
  2. Even after the order confirmation e-mail is sent, cases of partial or total unavailability of goods may occur. In this eventuality, the order will be rectified automatically with the deletion of the unavailable product and the user will be immediately informed by e-mail.
  3. If the user requests the cancellation of the order, terminating the contract, PASTICCERIA PERBELLINI will refund the amount paid within 30 days from the time PASTICCERIA PERBELLINI became aware of the buyer's decision to terminate the contract.

ARTICLE 7 - TERMS OF PAYMENT AND PRICES

  1. The price of the products will be as stated from time to time on the site, except where there is an obvious error.
  2. In case of error PASTICCERIA PERBELLINI will warn as soon as possible the buyer allowing the confirmation of the order to the correct amount or the cancellation. It will not exist to every way for PASTICCERIA PERBELLINI the obligation to supply how much sold to the inferior price erroneously indicated.
  3. Site prices include VAT and do not include shipping costs. Prices are subject to change at any time. Changes do not affect orders for which order confirmation has already been sent.
  4. Once the desired products have been selected, they will be added to the shopping cart. You will simply follow the purchase instructions, entering or verifying the required information at each step of the process. Order details may be changed before payment.
  5. Payment for the purchased products and related shipping costs must be made by the customer when submitting the order confirmation through the use of Visa or Mastercard credit cards or by bank transfer.
  6. The prices shown on the site do not include any customs duties or taxes applicable in the country of destination of the products and/or services where this is different from Italy. These costs, which differ from country to country, are the responsibility of the customer, who is responsible for verifying the amount with the competent customs authorities.
  7. Pasticceria Perbellini reserves the right to cancel orders for which payment has not been received within 15 days after the order is placed.
 

The online credit card transaction will take place through the STRIPE secure circuit. For credit card payments, user data is transmitted encrypted according to the SSL (Secur Socket Layer) system directly to STRIPE's server, which guarantees the security of data transmission according to current banking procedures.

ARTICLE 8 - DELIVERY

  1. PASTICCERIA PERBELLINI ships throughout the country and to most European states.
  2. The shipping cost for Italy is fixed regardless of the quantity ordered. For shipments to the rest of Europe, however, the cost is calculated according to the quantity ordered.
  3. PASTICCERIA PERBELLINI will make its deliveries either to the home provided by the user or to the pick-up points indicated at the time of purchase by express courier UPS, FERCAM, TNT or DHL.
  4. Orders will be processed only when the goods are fully available, normally within 3 working days from the date of the order. If it is not possible to ship the goods due to problems or difficulties related to environmental causes, health emergencies, strikes, etc., we will contact the buyer.
  5. The couriers used will not make advance phone calls or handle requests for shipments at particular times. They will make the first delivery without prior notice. If the customer is absent, a notice will be left and they will proceed with a new delivery within the next 24 hours (either at home or at a pick-up point). In case of further absence, a new notice will be left and the customer will have to contact the courier to work out the details of the delivery. If this attempt is also unsuccessful, the goods will be returned to Pasticceria Perbellini Ernesto Srl resulting in cancellation of the order and nothing will be refunded to the Customer. In this case Pasticceria Perbellini Ernesto Srl reserves the right to charge the Customer's credit card the additional shipping costs for the return of the goods.
  6. As a result of the termination of the contract, if it happens, the amounts will be returned, including delivery costs with the exclusion of any additional costs resulting from the choice of a delivery method other than the ordinary method offered without undue delay and, in any case, within 15 days from the date on which the order was properly returned to the sender, after verification of the contents. Transportation resulting from the termination of the contract may have additional costs that will be borne by the buyer.
  7. Shipping costs are the responsibility of the buyer and are highlighted explicitly when placing the order.
  8. Each shipment will contain a detail of the products sent.
  9. Pasticceria Perbellini Ernesto Srl will issue a regular receipt and any invoice if requested at the time of order. It is therefore not possible to request an invoice at a time after the completion of the order.
  10. During holidays Pasticceria Perbellini Ernesto Srl cannot assume any responsibility for any delays in the delivery of orders, attributable solely to the service conditions of the couriers used. Orders received on Saturday, Sunday and Monday will be handled on the following Tuesday.
  11. Upon delivery of the goods by the courier , the Customer is required to check:
  • That the number of packages being delivered corresponds to the number on the transport document,
  • That the packages are undamaged, undamaged, neither wet nor otherwise altered even in the closing materials (paper, tape, string).

Any damage or mismatch in the number of packages, must be immediately reported to the delivering courier by marking "collection with reservation" on the appropriate transport document and confirmed, within 3 days , by e-mail, to: ecommerce@perbellini.com

Only after such verification must the Customer accept the delivery, after which he may not object to the quantity of the packages and the external characteristics of what is delivered to him.

If, on the other hand, the goods received do not correspond to those ordered, the anomalies found must be reported within two days of receipt by e-mail to: ecommerce@perbellini.com.

To ensure the proper transportation of products, each package will be packed in the most appropriate manner, using recycled paper where necessary to avoid bumps between products. This choice is in line with the company's policy against waste and in favor of the environment.

ARTICLE 9 - PASSING OF RISK

  1. Risks relating to the products will pass to the purchaser from the time of delivery. Ownership of the products shall be deemed to have accrued upon receipt of full payment of all amounts due in connection therewith, including shipping charges, or upon delivery, should this occur at a later date.

ARTICLE 10 - WARRANTY AND COMMERCIAL COMPLIANCE

  1. In the event that the Customer finds any deterioration or defects in the material received, he/she must give notice within two days of receipt by e-mail to: ecommerce@perbellini.com.

Any report after the above deadlines cannot be considered.

ARTICLE 11 - WITHDRAWAL

  1. Pursuant to Article 59 letters c), d) and e) of the Consumer Code, given the special nature of the goods offered for sale, the provisions on the exercise of the customer's right of withdrawal do not apply.
  2. Pasticceria Perbellini Ernesto Srl reserves the right not to accept or cancel an order received or an item included in the order in case of credit card fraud.

ARTICLE 12 - DATA PROCESSING

  1. The buyer's data are processed in accordance with the provisions of the legislation on the protection of personal data, as specified in the appropriate section containing the information pursuant to Article 13 EU Regulation 2016/679 (Privacy Policy).

ARTICLE 14 - APPLICABLE LAW AND PLACE OF JURISDICTION

  1. These General Terms and Conditions of Sale shall be governed by and construed in accordance with the laws of Italy, without prejudice to any different overriding mandatory rules of the purchaser's country of habitual residence. Accordingly, the interpretation, performance and termination of the General Conditions of Sale shall be subject exclusively to Italian law.
  2. Any disputes inherent and/or consequent to the same shall be resolved exclusively by the Italian jurisdictional authority. In particular, if the user has the status of Consumer, any disputes shall be resolved by the court of the place of domicile or residence of the same according to the applicable law.
